terms of service



This Agreement ("Agreement") is made and entered between Photographer (Taisiia Nikulnikova) and the Client.

1. Description of Services

Photographer agrees to provide Client with photography services (the "Services") as described in the package details agreed upon by the parties in writing. The Services will be performed at the location specified in the agreed upon package details on the Effective Date.

2. Performance of Services

Photographer will perform the Services in a professional and workmanlike manner, using commercially reasonable skill and care.  Photographer retains creative control over posing, composition, and artistic aspects of the photography session. Photographer's editing style, applied at their discretion, is final. Final photographs may differ from Photographer's portfolio due to various factors, including lighting, location, and individual characteristics.

3. Final Product and Ownership

Client may not alter or modify the final photographs delivered by Photographer. Client owns the final photographs and may use them for personal or commercial purposes. Client grants Photographer a non-exclusive, worldwide, royalty-free license to use the final photographs for self-promotion and portfolio purposes. Photographer will deliver the final photographs in JPEG format via a file-sharing service (e.g., WeTransfer, Pixieset) within 25 business days of the session, unless agreed for otherwise. You'll receive your final photos in JPEG format. What's included depends on the package: Studio or home sessions include specified number of fully retouched, high-resolution images ready for printing. You'll also get most of the other good photos from the session with basic color correction. For events, you'll get around 50-80 photos for every hour I shoot. These will have light edits to improve lighting and colors

4. Payment

Client shall pay Photographer the total fee specified in the agreed upon package details. Full payment is due on the Effective Date of the session. If a deposit is agreed upon, it is non-refundable and will be applied towards the total fee. All payments are non-refundable, except as provided in Section 5.

5. Cancellation

Client may reschedule the session with at least 48 hours' written notice. Cancellations with less than 48 hours' notice will result in forfeiture of the total fee, except for circumstances beyond Client's control (e.g., labor, accidents, emergencies). If Photographer cancels the session, Client will receive a full refund of any payments made.

6. Acknowledgement and Acceptance

By proceeding with the photography services and making payment, Client acknowledges that they have read, understood, and agreed to all terms and conditions of this Agreement.

7. Entire Agreement

This Agreement constitutes the entire agreement between the parties with respect to the subject matter herein and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.   

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Ontario, Canada.
